On 6 July 2016, Gretchen announced her departure from FOX News via her Twitter. On the same day, she filed a sexual harassment lawsuit against FOX News chairman Roger Ailes in the Superior Court of New Jersey. In her lawsuit, she mentioned that she got fired from her program for turning about his sexual advances. After her allegation, she got widespread media coverage and six more women came forward alleging Roger for sexual harassment.

As the case was progressing she got much support and she also claimed Roger forced her to be adjudicated via closed-door mandatory arbitration rather than in court. Later on 6 September 2016, the lawsuit was settled with $20 million.
